1. Agreement to terms

These Terms & Conditions ("Terms") govern your access to and use of the KreativTek website and services ("Services"). By accessing the website or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the website or Services.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use our Services. If you use the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms.

3. Services

We provide web hosting, WordPress development, game server hosting, file storage, IT/CRM tools, and related solutions. Specific features, pricing, and service levels for your plan are described at the point of purchase or in a separate service agreement, which forms part of these Terms.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate, current information and to keep it up to date.

5. Acceptable use

You agree not to use the Services to:

• Violate any law or regulation, or infringe the rights of others.
• Distribute malware, spam, or unlawful, harmful, or fraudulent content.
• Attempt to gain unauthorized access to, disrupt, or overload our systems or networks.
• Resell or abuse the Services in a way that degrades performance for other customers.

We may suspend or terminate Services that violate this section.

6. Fees & payment

Paid Services are billed in advance on the cycle shown at checkout (for example, monthly or annually) unless otherwise agreed. Fees are non-refundable except where required by law or expressly stated. You authorize us and our payment processor to charge your chosen payment method for recurring fees until you cancel. Late or failed payments may result in suspension or termination.

7. Cancellation & termination

You may cancel your Services at any time as described in your account or by contacting us; cancellation takes effect at the end of the current billing cycle. We may suspend or terminate your access for violation of these Terms, non-payment, or as required by law. Upon termination, your right to use the Services ends and we may delete associated data after a reasonable period.

8. Intellectual property

The website, our Services, and all related content (excluding content you provide) are owned by KreativTek or its licensors and are protected by intellectual property laws. You retain ownership of content you upload; you grant us a limited license to host and process it solely to provide the Services.

9. Third-party services

The Services may rely on or link to third-party products and services. We are not responsible for third-party offerings, and your use of them is governed by their own terms.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

11. Limitation of liability

To the maximum extent permitted by law, KreativTek will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data. Our total liability arising out of or relating to the Services will not exceed the amount you paid us for the Services in the three (3) months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless KreativTek from any claims, losses, or expenses (including reasonable legal fees) arising out of your use of the Services, your content, or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Georgia for any disputes not subject to other agreed dispute-resolution processes.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Your continued use of the website or Services after an update constitutes acceptance of the revised Terms.
